5 Things to Know About Renewing a Trade Mark
Protect your intellectual property for another 10 years by promptly renewing your trade mark registration online. It is effective immediately.
Keep or Let Lapse
Your trade mark is only registered for 10 years initially. So when IP Australia sends you a trade mark renewal letter, you need to decide whether it is appropriate to continue protecting the IP identified in your trade mark.
Confirm Your Details
Before you renew your trade mark, let IP Australia know if your personal details have changed. Otherwise, you risk not receiving important correspondences relating to your trade mark.
Discard Irrelevant Classes
You may want to remove some classes of goods and services from your trade mark registration that are no longer relevant. You need to submit an online request at least three weeks’ before the renewal date.
Pay the Renewal Fee
You can renew your trade mark, effective immediately, through IP Australia’s online services. The renewal fee can be paid from 12 months before the renewal date, and up to six months after the renewal date (subject to late fees).
Impact of Late Renewal
If you do not pay your renewal fee on time, your trade mark will be removed from the register and cannot be reinstated. You will no longer have registered exclusive rights to use, license and sell your trade mark.
