Using the \u2018\u00ae\u2019 Symbol Without Registering&nbsp;&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the benefits of registering your trade mark with IP Australia is using <a href=\"https:\/\/trademark-registration.com.au\/australian-application\/what-does-the-symbol-mean\/\">the registered trade mark symbol<\/a> (\u2018\u00ae\u2019). This informs others that Australian trade mark law protects your intellectual property rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, using the registered trade mark symbol <em>without <\/em>actually registering your trade mark is an offence under the Trade Marks Act. However, you should display the symbol in an area that the public can clearly see. Typically, trade mark owners will place the symbol on the upper right-hand of their trade mark.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"3-misunderstanding-trade-mark-protection\">3. Misunderstanding Trade Mark Protection&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Merely displaying your trade mark symbol with your sign will not necessarily prevent others from copying or misusing your trade mark. After all, people can infringe on your intellectual property despite being aware that you own a registered trade mark.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, you must ensure that you take additional measures to enforce your rights concerning your trade mark. This might mean that you scan the marketplace for any potential infringements and your exclusive rights to your registered trade mark if you think there has been a likely infringement.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>Trade mark infringement occurs when a trader uses a sign that is substantially identical with, or deceptively similar to, a registered trade mark concerning the same or similar goods and services.
