Whilst missing a deadline can be fatal to your opposition, there is a chance that you can apply for a time extension with IP Australia during any stage of the opposition proceedings. This article outlines the steps to applying for a time extension during opposition proceedings with IP Australia.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">1. Under the <\/span><i><span style=\"font-weight: 400\">Trade Marks Act<\/span><\/i><span style=\"font-weight: 400\">, the two reasons for granting a time extension for failure to meet a deadline are where there has been a:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">genuine error or omission by you or your agent (likely, a lawyer acting on your behalf); or&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">circumstances beyond your control.&nbsp;<\/span><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">You must specify which of these reasons you are relying upon in your<\/span> <a href=\"https:\/\/www.ipaustralia.gov.au\/sites\/default\/files\/tm00033_0719.pdf\"><span style=\"font-weight: 400\">application for a time extension<\/span><\/a><span style=\"font-weight: 400\"> by ticking the relevant box and <\/span><a href=\"https:\/\/trademark-registration.com.au\/australian-application\/trade-mark-mistakes\/\"><span style=\"font-weight: 400\">filing the application<\/span><\/a><span style=\"font-weight: 400\"> with IP Australia.&nbsp;<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">You should note that a genuine error or omission on your behalf must be unintentional. In both circumstances, you must ensure that you have made all reasonable efforts to comply with the relevant filing requirements but were unable to do so for the reasons listed above. This will increase the likelihood of IP Australia accepting your application.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">2. Provide a Declaration&nbsp;<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">In your application, you must also attach a declaration. Put simply, a declaration is a comprehensive written statement of fact that explains in great detail why you could not meet a certain deadline. In your declaration, you must:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">fully disclose all the relevant circumstances that prevented you from meeting the deadline;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">detail the events that led to you not being able to meet the deadline; and&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">explain the error or the circumstances beyond your control that caused you to miss the deadline.&nbsp;<\/span><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">Moreover, you can support your declaration with further documentation to support the claims you have made. Indeed, to ensure that you do not miss important details in your declaration, you can fill in this<\/span> <a href=\"https:\/\/www.ipaustralia.gov.au\/sites\/default\/files\/dec00001-declaration_0.pdf\"><span style=\"font-weight: 400\">standard form<\/span><\/a><span style=\"font-weight: 400\"> provided by IP Australia.\u00a0<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">3.
