To help simplify the process, this article outlines:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the ins and outs of trade mark registration; and<\/li><li>the biggest mistakes you should avoid when registering a pharmaceutical trade mark.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Trade Marks and Classes&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Many people are unaware that you register trade marks in connection to a specific good or service. This means that a trade mark is only capable of protecting the goods and services that IP Australia has approved in your application.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>For example, suppose you manufacture a type of medicine and other products like bandages to support muscles, but only have a trade mark registered for the medicine. In that case, your trade mark <a href=\"https:\/\/trademark-registration.com.au\/australian-application\/add-a-class\/\">cannot protect the other products<\/a> when they are marketed and sold.<\/p><\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, you must be sure that the goods you specify in your application translate to the goods you intend to protect. If you forget to include a certain good in your application once you have submitted it to IP Australia, it is unlikely that you can amend your application. Therefore, you will likely have to submit a whole new application at an additional cost. To avoid this, you should familiarise yourself with the relevant classes particular to pharmaceutical goods.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Class 5 Goods<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Class 5 is a broad category containing a range of pharmaceutical goods. According to IP Australia\u2019s <a href=\"https:\/\/tmgns.search.ipaustralia.gov.au\/descriptions?class=5\">Trade Mark Classification Search<\/a>, goods in class 5 include:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>pharmaceutical and veterinary preparations;<\/li><li>sanitary preparations for medical purposes;\u00a0\u00a0<\/li><li>dietetic food and substances for medical or veterinary use;\u00a0<\/li><li>dietary supplements;\u00a0<\/li><li>plasters and materials for dressings;<\/li><li>dental wax;<\/li><li>disinfectants;\u00a0<\/li><li>preparations for destroying vermin; and<\/li><li>fungicides and herbicides.\u00a0<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The list of goods in class 5 is extensive. However, there is a summary of some key examples of these goods in the table below.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Pharmaceutical Good<\/strong><\/td><td><strong>Example<\/strong><\/td><\/tr><tr><td>Medicine<\/td><td>\u2022 Serotherapeutic medicines<br>\u2022 Herbal medicines<br>\u2022 Homeopathic medicines<br>\u2022 Medicines for medical purposes&nbsp;<\/td><\/tr><tr><td>Sanitary preparations<\/td><td>\u2022 Medical soap<br>\u2022 Sanitary preparations for personal hygiene, other than toiletries&nbsp;<\/td><\/tr><tr><td>Plasters and materials for dressing<\/td><td>\u2022 Adhesive strips&nbsp;<br>\u2022 Fabrics for dressing&nbsp;<\/td><\/tr><tr><td>Dietary supplements&nbsp;<\/td><td>\u2022 Both for humans and for veterinary purposes&nbsp;<\/td><\/tr><tr><td>Fungicides<\/td><td>\u2022 Turf fungicides<br>\u2022 Bacterial, fungal or other inoculants<br>\u2022 Insecticides&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Consider Other Classes&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on your business, there are likely to be more classes that apply to your application. To avoid missing out on any other relevant classes, you could conduct a comprehensive search of the Classification Search. Another way you can identify other classes that may be relevant to your business is by using the <a href=\"https:\/\/trademarks.business.gov.au\/assist\/welcome\">Trade Mark Assist Tool<\/a>. IP Australia created this program to help guide trade mark applicants through the application process. Additionally, it is a useful tool that you can use to identify other classes that may be relevant to your business.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Grounds for Rejection&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There are multiple grounds upon which IP Australia can reject your trade mark application. However, two grounds that are most relevant to pharmaceutical trade marks arise where an International Nonproprietary Name (INN) is used in your application. Put simply, an INN is a generic name for a substance or active ingredient in a drug like \u2018paracetamol.\u2019&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since an INN is a generic term that describes a family of substances, it is likely that others would also want to use the term when applying for a trade mark. Hence, a trade mark that contains an INN cannot distinguish the applicant\u2019s goods from those of another person. This means IP Australia can reject the application under section 41 of the <em>Trade Marks Act.&nbsp;<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a similar vein, since an INN has certain specific connotations, a trade mark that contains an INN is likely to deceive or cause consumer confusion. Consequently, IP Australia can reject the application under section 43 of the <em>Trade Marks Act.<\/em><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>This same rule also applies to using a notified INN stem. Some examples of an INN stem include the suffix \u2018-astine\u2019 for antihistaminics and the suffix \u2018-drine\u2019 for sympathomimetics. You can find a more comprehensive list of notified INN and INN stems at the World Health Organization&#8217;s website <a href=\"https:\/\/www.who.int\/teams\/health-product-and-policy-standards\/inn\/stembook\">here<\/a>.<\/p><\/blockquote>\n\n\n\n<h2 class=\"wp-block-heading\">Trade Mark Registration<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To apply for a registered trade mark, you must file an application via <a href=\"https:\/\/portal.ipaustralia.gov.au\/login\">IP Australia\u2019s online services<\/a>. You can either apply using a <a href=\"https:\/\/trademark-registration.com.au\/australian-application\/standard-tm-headstart-application-difference\/\">standard form application or a TM Headstart application<\/a>. Using a standard form, you must provide amongst other things:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a description of the goods that your trade mark will protect;<\/li><li>certification that you have conducted a trade mark check to ensure that someone else has not already registered your intended trade mark; and<\/li><li>the class of services that your trade mark will apply to, i.e. class 5 on the Trade Mark Classification Search, which includes pharmaceutical products.&nbsp;<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You will still need to complete all the formal requirements of a standard application when using a TM Headstart application. However, a TM Headstart application provides you with an additional service where a trade mark expert undertakes a pre-assessment of your application before you formally submit it for IP Australia\u2019s review.
