ASIC has a <a href=\"https:\/\/connectonline.asic.gov.au\/RegistrySearch\/faces\/landing\/bn\/SearchBnRegisters.jspx?_adf.ctrl-state=15z3a5sjy9_20\">business name register<\/a> where you can check if your proposed business name is identical or near-identical to another business name already registered. A business name that is identical or near-identical to another business or company name will not be available for you to use.<\/p>\n\n<p class=\"wp-block-paragraph\">A number of rules apply when determining the availability of business names. Aside from checking that your proposed business name is not identical or near-identical to an existing registered name, there are several other factors that determine whether or not you can use your proposed business name. Other factors that ASIC will consider are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>unknown words. This may include misspelled words or made up words. ASIC will have to manually assess these words to check whether they can be used;<\/li>\n<li>undesirable words or phrases. You cannot use any offensive words or expressions in your business name;<\/li>\n<li>use of invalid characters. This includes special characters like the \u2018greater than\u2019 symbol (&gt;) or accented characters (such as \u00e7 or \u00e8); and<\/li>\n<li>restricted words. This includes words such as \u2018university\u2019, \u2018bank\u2019 or \u2018charity\u2019. In order to use these restricted words in your business name, you must apply to ASIC and explain in writing why your business meets the relevant criteria to use the restricted word.\u00a0<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Registering Your Business Name\u00a0<\/h2>\n\n<p class=\"wp-block-paragraph\">Once you have chosen your business name, you will need to <a href=\"https:\/\/trademark-registration.com.au\/\/information\/register-business-name-as-trade-mark\/\">register it<\/a>. For new businesses, you can do this through the Australian Government\u2019s<a href=\"https:\/\/register.business.gov.au\/\"> Business Registration Service<\/a>, where you must first register to get an Australian Business Number (ABN).\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">If you already have an ABN, you can apply for a business name directly through ASIC using<a href=\"https:\/\/asic.gov.au\/for-business\/registering-a-business-name\/steps-to-register-your-business-name\/\"> ASIC Connect<\/a>.
