However, before you file to register your company logo with IP Australia, you should consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>whether filing a composite mark is more beneficial to your company;<\/li>\n\n\n\n<li>conducting a trade mark search to ensure a similar or identical trade mark does not already exist; and<\/li>\n\n\n\n<li>which trade mark classes you should include in your application.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Composite Marks<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Trade marks are more than just a company logo. Instead, a trade mark can include your:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>business name;&nbsp;<\/li>\n\n\n\n<li>slogan;&nbsp;<\/li>\n\n\n\n<li>distinctive colour; and&nbsp;<\/li>\n\n\n\n<li>even smell.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For this reason, you might consider registering a composite mark.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What is a Composite Mark?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A <a href=\"https:\/\/trademark-registration.com.au\/renewal\/composite-trade-mark-expires\/\">composite mark can protect the overall impression of your business logo<\/a> and business name. For example, the McDonald&#8217;s logo is a composite trade mark. At its core, a trade mark must distinguish your company&#8217;s goods and services from others in the market. For this reason, IP Australia will likely reject your trade mark application if it is similar or identical to an existing mark.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To minimise your chances of IP Australia rejecting your application, you should search the<a target=\"_blank\" href=\"https:\/\/search.ipaustralia.gov.au\/trademarks\/search\/quick\" rel=\"noreferrer noopener\">&nbsp;Australian Trade Mark Search<\/a>. By entering the keywords in your logo or uploading an image of your logo, you can identify whether another business has already registered a similar or identical trade mark.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In saying that, there could be instances where <a href=\"https:\/\/trademark-registration.com.au\/australian-application\/trade-marks-and-business-names\/\">IP Australia accepts two similar trademarks<\/a>. For example, a bookstore in Sydney might have a registered trademark similar to a trade mark that a restaurant owner uses in Melbourne. In this instance, the trademarks could co-exist since they protect different goods and services in different industries.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trade Mark Classes&nbsp;<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When you file your trade mark application with IP Australia, you must specify which goods and services you want your registered trade mark to protect. This is important given your trade mark protection will&nbsp;<em>only<\/em>&nbsp;cover the goods and services IP Australia accepts in your application.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, suppose your company offers physical therapy and sells essential oils but you only register your company&#8217;s logo in connection with therapy services under class 44.
